EHM Program Rules & Scheduling Requriements

I. General Restrictions and Conditions

  1. Electronic Monitoring requires that Participant remain at Participant’s home at all times, except for authorized leave. Any exceptions must be approved by the Court or Participant’s supervising probation officer and written verification of any authorized leave must be provided to the Agency. The Agency requires 24 business hours’ notice to make any approved schedule changes.
  2. Participant acknowledges that Participant must comply with the rules associated with Electronic Monitoring including avoiding the victim’s residence or known proximity as ordered by the Court. If Participant is notified by the Agency that Participant is in the proximity of the victim, Participant shall leave the area immediately. Failure to do so will result in a violation report being sent to the Court and the local police department being notified of your refusal to comply.
  3. The following are approved outings under the conditions noted:
    • Participant may attend court-ordered classes or appointments if such are noted on the referral from the Court.
    • Participant may attend school and work as long as it is approved by the Court, Participant provides written documentation and proof of school and work schedule to the Agency, and the Agency has verified the school or work schedule. Participant agrees that the Agency may contact the school or work supervisor to verify school or work schedule. Only the Court can approve employment, including “under the table” or informal arrangements; the Agency cannot approve employment without prior Court approval.
    • Participant may attend medical and dental appointments, legal or court appointments, appointments for ignition interlock device calibration, and appointments at the Department of Licensing if the Agency is notified at least one week prior to the appointment.
    • Participant may attend Alcoholics Anonymous (AA) or Narcotics Anonymous (NA) meetings at verifiable meeting locations only. No outside locations for meetings can be approved, including for meetings with a sponsor, unless previous written authorization from the Court has been filed with the Agency.
    • Participant may stop at a gas station to fill up the gas tank of their vehicle if Participant has a valid driver’s license and submits a picture of the gas receipt to the Agency within 12 hours of the stop.
    • Participant may travel for necessity care for minor children (this does not include sporting events or before/after school activities) and for the purpose of grocery shopping if and only if criteria provided by the Agency is met.
    • Any other travel, appointment, or outing must be approved by the Court.
  4. If Participant is self-employed, Participant shall provide a copy of Participant’s business license and verification from work sites to allow the Agency to document work locations.
  5. Participant acknowledges that Electronic Monitoring is a jail alternative program. Alcohol consumption and the use of illegal substances is strictly prohibited.
  6. Participant agrees to submit to a breathalyzer or drug test, at Participant’s sole expense, at any time upon the Agency’s request at the location of the Agency’s choice on the same business day that such test was requested.
  7. All of Participant’s movements and substance readings will be tracked and stored as an official record.
  8. Participant shall notify the Agency regarding Participant’s current health status and any pre-existing medical conditions including, but not limited to, pregnancy, diabetes, or any type of skin disorder or condition, as well as any prescriptions that might affect the results of a breathalyzer or drug test.
  9. If Participant fails to comply with any of the above policies, the Agency will file a violation report with the Court.

 

II. Schedule and Communication

  1. Participant shall submit a weekly schedule to the Agency via email to ehm@securecourt.com or via text to 509-795-2711 throughout the duration of monitoring. Any deviation from the schedule provided to the Agency will result in a violation report being sent to the Court.
  2. The Agency will respond to schedules submitted during business hours only. If Participant does not receive a response to a submitted schedule within two (2) hours of submission, Participant may contact the Agency by telephone. Outside of business hours, Participant is not authorized to change Participant’s schedule unless it is an emergency.
  3. Participant shall contact the Agency regarding any and all emergencies before leaving Participant’s home zone. After-hours emergencies must be reported immediately by telephone (not email) to the after-hours answering service. Failure to contact the Agency prior to leaving the home zone may result in a violation report being sent to the Court. In case of a serious or life-threatening emergency, Participant may travel to a hospital emergency room without prior authorization from the Agency. Do not wait for a callback from the Agency.
  4. Participant shall maintain phone services for the duration of Electronic Monitoring and shall ensure that the Agency has the correct and current contact information for Participant at all times.
  5. Participant agrees to program the Agency’s phone number and text line into Participant’s phone to ensure that calls and texts from the Agency are recognized as such, and grants the Agency permission to text Participant.
  6. Twenty-four business hours’ notice is required for any schedule change to allow the Agency to change the schedule in the monitoring system.
  7. If Participant’s work schedule changes, Participant must report to the Agency immediately via email or text (no phone calls). If Participant’s employment has already been verified by the Agency and Participant is called into work at a different time than previously provided, Participant must contact the Agency via email or text (no phone calls) to report the work schedule change, and then may proceed to work.
  8. If the Agency attempts to contact Participant by telephone, Participant shall return the call before the end of that business day (4:30 p.m.).
  9. If the Agency notifies Participant, including via voicemail, that Participant must be seen in the Agency office, Participant shall comply within 24 hours of notification.
  10. If Participant’s place of residence changes, Participant must obtain approval from the Court and shall give the Agency at least 48 hours’ notice. If Participant’s employment is terminated, Participant must notify the Agency within 12 hours.
  11. In the event of a power outage, loss of telephone service, fire, flood, or medical emergency, or other similar event, Participant must contact the Agency immediately.
  12. Pursuant to RCW 9.73.030, Participant consents to and agrees that the Agency may listen to and record phone calls between Participant and any agent or representative of the Agency. Participant acknowledges and agrees: (i) that Participant’s signature on this document constitutes Participant’s actual consent to such recording and transmission by the Agency under RCW 9.73.030; (ii) that no additional notice to Participant is required from the Agency; and (iii) the Agency may use such recordings for any purpose whatsoever, including but not limited quality monitoring purposes.
  13. If Participant fails to comply with any of the above policies, the Agency will file a violation report with the Court.
